1. INTRODUCTION

These Terms and Conditions (the “Terms”) apply to BUYPARKING.CO.UK (“we”, “our”, or “us”), our Application and our website located at https://buyparking.co.uk/ (“Site”) and any service that is offered on the Site through BUYPARKING.CO.UK which is owned and operated by STX GROUP LIMITED.
This is a legal document which contains contractual provisions (the “Terms and Conditions”). These terms and conditions of booking are governed by English Law and are subject to the exclusive jurisdiction of the English courts. If any of these terms or part of any term are found to be invalid illegal or unenforceable then such term(s) shall be deemed modified to the minimum extent necessary to make it/them valid, legal and enforceable. If such modification is not possible the relevant provision or part-provision shall be deemed deleted. Any such modification to or deletion of a term or part term shall not affect the validity and enforceability of the rest of these terms.
By accessing, browsing or using this Site, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions (these “Terms”). If you do not agree to these Terms, you should not use or access this Site. BUYPARKING.CO.UK reserves the right to revise these Terms at any time by updating this posting. You are encouraged to review these Terms each time you use the Site because your use of the Site after the posting of changes will constitute your acceptance of the changes. We grant you a personal, limited, non-transferable non-exclusive, license to access and use the Site. We reserve the right, in our sole discretion and without notice to you, to revise the services available on the Site and to change, suspend or discontinue any aspect of the Site and we will not be liable to you or to any third party for doing so. We may also impose rules for and limits on use of the Site or restrict your access to part, or all, of the Site without notice or penalty. Your continued use of the Site will constitute your acceptance of any such changes

2. PERMITTED USE

a. The Site is for your personal, non-commercial use only. It may only be accessed and used by a private individual or by a business to seek a Service directly for that individual or business. Access to and use of the Site other than for your personal, non-commercial purposes is strictly prohibited.
b. You are not permitted to use the Site:

in any unlawful, fraudulent or commercial manner;
to harm, threaten, abuse, embarrass, defame, libel, intimidate or harass another person, or in a way that invades another person’s privacy or is obscene, offensive, hateful, indecent, inappropriate, objectionable, unacceptable, discriminatory or damaging as determined by us;
to create, check, confirm, update, modify or amend another person’s records;
to tamper with, modify, reverse engineer or amend any part of this Site;
in a way that interferes with, disrupts or imposes an unreasonable or disproportionately large burden on our communications and technical systems; or
with any automated software, process, program, robot, web crawler, spider, data mining, trawling or other “screen scraping” software, process, program or system

c. This Site is intended for use only by customers who are located in the UK. We make no warranty or representation that any product and/or any service we provide is available or otherwise appropriate for use outside of the UK. If you choose to use the Site from locations outside the UK, you do so at your sole risk and you are responsible for compliance with all applicable local laws.

d. Our Site is intended for the use of customers aged 18 or over only.

e. Where the customer is aged between13-16, we will require a parent or legal guardian to complete the enquiry on their behalf.

f. You may operate a link to the Site provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, as determined by us. You must not operate a link to the Site in such a way as to suggest or imply any form of association, approval, or endorsement by us. We reserve the right to require you to remove any link to the Site immediately and at any time and we may withdraw any linking permission at any time.

3. OUR LIABILITIES

We will use all reasonable endeavours to ensure that our BuyParking.co.uk Car Parks are secure but you park at your own risk.
We will act with reasonable skill and care when providing services but our responsibility is limited and is that arising from our negligence or the negligence or dishonesty of our staff or agents.
We do not accept liability for: a. the security of your vehicle and/or its contents. b. damage to the vehicle, whether caused accidentally or by way of vandalism. c. indirect or consequential loss of profit, enjoyment, revenue, data or earnings. d. any failure by us to perform obligations due to an event beyond our reasonable control.
If the equipment in the BuyParking.co.uk Car Park is damaged by you, your vehicle or the passengers in the vehicle then, except where the damage arises from our negligence, we will seek to recover the cost of that repair and associated administration costs from you.
If your vehicle sustains damage while in the BuyParking.co.uk Car Park or if you lose your vehicle or any of your possessions from your vehicle you should immediately inform a member of staff at the BuyParking.co.uk Car Park customer service office.
Any damage to another customer’s vehicle caused by you should be reported to the BuyParking.co.uk Car Park customer service office. You must also notify the owner of the other vehicle by leaving a note on the windscreen of their vehicle providing your vehicle and contact details and any other details that are relevant to the incident.

4. SECURITY OF YOUR VEHICLE

a. Unless requested by a member of our staff not to do so, please ensure that before you leave the BuyParking.co.uk Car Park:
b. your vehicle is securely locked;
c. all of the windows of your vehicle are securely closed;
d. if your vehicle is fitted with a vehicle alarm, steering lock, or similar device, that it is engaged;
b. Where CCTV cameras are installed in any of our BuyParking.co.uk Car Parks they are used to assist in the proper running of the BuyParking.co.uk Car Park. The CCTV cameras may also act as a deterrent to criminal activity. We are obliged by law to display signage in the BuyParking.co.uk Car Park advising that CCTV cameras are in operation. However, we do not make any representation as to the extent of coverage provided by the cameras and no guarantee is given as to the security of your vehicle in BuyParking.co.uk Car Parks where CCTV is installed.

5. POSSESSIONS

a. Wherever possible please take your possessions with you when you leave your vehicle.
b. If you do leave possessions in your vehicle, you do so at your own risk. Therefore, please do not leave them where they are visible. You should lock them in the boot or in an equivalent, secure, out-of-sight storage area within your vehicle.
c. You are reminded that your vehicle insurance policy may not cover possessions in your vehicle. It may be possible to arrange separate insurance cover for such possessions and we encourage you to do so.

6. CLAIMS AND COMPLAINTS PROCEDURE

a. If your vehicle sustains damage while in the BuyParking.co.uk Car Park or if you lose your vehicle or any of your possessions from your vehicle while it is in the BuyParking.co.uk Car Park, you should:
b. immediately either inform a member of our staff at the BuyParking.co.uk Car Park or contact our staff at the control room for the BuyParking.co.uk Car Park or otherwise notify our BuyParking.co.uk Car Park Manager on .
c. in the case of theft, immediately inform the police;
d. notify your insurers promptly.

7. REGISTRATION AND SEASON TICKETS

You will be required to register your details and/or open an account to access the full Payment Service on the Website and App, or the Telephone Service (as applicable). You undertake to complete the registration form fully, and that all information provided is up to date, true, accurate and complete.
Each registration for the Payment Service is for a single user only. We do not permit you to share your user name and / or password with any other person nor with multiple users on a network.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party.
In respect of the Website and App, we strongly recommend that your Device is protected by a suitable pin number or password so that if your Device is lost/stolen, any stored details cannot be used or accessed without your permission. You acknowledge and agree that, we have no obligation to refund to you any accepted booking requests that are made while your Device is lost or stolen.
BuyParking.co.uk has the right to disable any account, user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

Season Tickets. As part of the Payment Service, you can purchase parking season tickets through our Website and App or our Office at the Airport or Telephone Service (if applicable) for such periods of time and at such prices as are published on the Website and App from time to time. We reserve the right to change the duration and prices of a season ticket (before purchase) at any time. Current prices will always be shown on the Website and App and, if for any reason we need to change the duration of a purchased season ticket, we will do so only in accordance with these terms.
Auto-renewal. When you purchase a season ticket, you can choose to automatically renew that season ticket for the same duration. Please ensure that you have a valid credit or debit card registered on your account. Failure to do so may result in the loss of your permit

The ticket issued to you is for use only for the vehicle in respect of which it is issued. A ticket does not entitle you (unless otherwise specified by us) to any particular space in the BuyParking.co.uk Car Park or to priority over other customers. Payment for a does not guarantee you a parking space.

We reserve the right to refuse to release your vehicle from our BuyParking.co.uk Car Park if you are unable to produce a valid BuyParking.co.uk Car Parking ticket until we have made such enquiries as we consider reasonable. Failure to produce a valid ticket may therefore delay your departure.
We reserve the right to refuse to release any vehicle for which a valid and current ticket, or Season Ticket, cannot be produced, until we have made reasonable enquiries. If you are unable to produce a valid BuyParking.co.uk Car Parking ticket you will be charged at Lost Ticket rate which is clearly advertised on the tariff board at the BuyParking.co.uk Car Park entry.

8. TARIFF AND CHARGES

BuyParking.co.uk Car Park booking quotes are valid at the time of booking only.
All prices shown are in British Pounds and include VAT at the current rate.
The BuyParking.co.uk Car Park charges are priced per period of 24 hours or part thereof.
The quote is based on the number of periods of 24 hours or ‘days’ and these are calculated on the basis of the times selected when making the booking.
If the entry and exit times change from that specified in the booking and the actual time in the BuyParking.co.uk Car Park runs into another 24 hour period, an additional day’s charge, at the tariff rate displayed at the entrance to the BuyParking.co.uk Car Park, will be required and this amount must be settled before leaving the BuyParking.co.uk Car Park.
Additional over-stay charges will apply irrespective of the reason unless a delayed return is caused by the negligence of the BuyParking.co.uk. The parking fees payable are displayed on the tariff board at the BuyParking.co.uk Car Park entrances and at pay stations. You are obliged to pay the fee and to comply with any instructions on the tariff board.
If you fail to collect your vehicle more than 30 days after the date which you have specified for exit in the booking, and we are not notified of the reason, then we will deem the vehicle to have been abandoned. In such circumstances we shall be entitled to remove and sell the vehicle and deduct from the proceeds both our reasonable handling expenses and any unpaid sums for days in which the car has been in the BuyParking.co.uk Car Park.

9. AGENCY

Every person who enters into a contract with the BuyParking.co.uk for the parking of a vehicle at the BuyParking.co.uk Car Park, whether by purchasing a ticket or otherwise, does so on behalf of themselves and all other persons having proprietary, possessory or other financial or material interest in the vehicle and/or its contents.

10. MOVING AND RELOCATION OF VEHICLES

We reserve the right to move any vehicle within the BuyParking.co.uk Car Park by driving or other means to such extent as we, our staff or agents at their discretion think necessary to avoid obstruction, for the more efficient arrangement of parking facilities and/or for health and safety reasons.
We reserve the right, where the BuyParking.co.uk Car Park has to be closed permanently, temporarily in whole or in part, evacuated or in cases of emergency, to remove any vehicle at such a time to any other reasonably convenient BuyParking.co.uk Car Park.

11. PARKING CONTRAVENTION

a. It is important to the effective management of the BuyParking.co.uk Car Park:
b. that you do not park within a bay designated for a specific purpose when you are not entitled to do so (e.g. parking in a space for the disabled without an appropriate disability badge displayed);
c. that you park within a marked bay;
d. that, in relation to pay and display sites, you comply with the requirements set out and your vehicle does not remain in the BuyParking.co.uk Car Park for longer than the duration allocated and paid for; and
e. that you comply with all signs in the BuyParking.co.uk Car Park.
f. If you do not comply with these requirements then we may issue you with a Parking Contravention Charge Notice. We issue such notices because we will incur a loss as your actions will prevent the efficient management of the BuyParking.co.uk Car Park. The amount of the Parking Contravention Charge represents a genuine pre-estimate of the additional expense incurred by us as a result of your incorrect parking.
g. If you incur a Parking Contravention Charge a Notice will be given to you or attached to your vehicle. If payment is received within 14 days of the Parking Contravention Charge being issued, the amount of the charge will be reduced in accordance with the provisions of the Notice.
h. Payment may be made by one of the methods detailed in the “Instructions for Payment” section of the Parking Contravention Charge Notice. Please quote your vehicle registration number and Parking Contravention Charge Notice number when making payment.
i. Failure to pay the Parking Contravention Charge within 28 days of the Parking Contravention Charge Notice being issued will result in us being entitled to take legal action against you for breach of contract, and may result in court proceedings
j. If you consider that we have wrongly issued a Parking Contravention Charge Notice you may appeal, by writing to the address detailed on the Parking Contravention Charge Notice itself. We will then consider your appeal and notify you of our decision. Please note that if your appeal is made within 28 days of the date of issue of the Notice, your payment period will be extended by the time taken to determine the appeal.
k. The use of this BuyParking.co.uk Car Park may be regulated by traffic orders or byelaws under which a penalty may be payable for failing to comply with these terms and conditions or the requirements of the relevant order or byelaw. In such circumstances, separate notices specifying the relevant order or byelaw will be displayed in the BuyParking.co.uk Car Park.

12. LIENS

We reserve the right to hold your vehicle until we have received payment for all parking charges due to us and we reserve the right to refuse any vehicle until those charges have been paid.
If you intend to leave your vehicle in the BuyParking.co.uk Car Park for more than 30 days we recommend that you notify us in writing of your intention to do so.
We reserve the right to sell any vehicle which we reasonably believe to have been abandoned and shall be entitled to regard as abandoned any vehicle which has been in the BuyParking.co.uk Car Park for more than 30 days without prior notification and which is not known to be covered by a current valid premier card.
Before proceeding with the disposal of abandoned vehicles, we will make reasonable enquires with a view to identifying and contacting the registered owner of the vehicle in question; give 28 days notice of our intention to do so to the registered owner by pre-paid post addressed to the registered owner’s last known address.
Abandoned vehicles will be sold by auction whenever practicable and the proceeds of the sale will be applied in and towards satisfaction of all sums owing to us together with the expenses of sale and in connection with such sale we shall be entitled to charge reasonable garage charges in respect of the period during which the vehicle is in our possession.
Any balance of these sales proceeds remaining after satisfaction of such sums shall be held by us on behalf of the registered owner of the vehicle and paid over on proof of entitlement.

13. PROHIBITED ACTIVITIES

a. You must not tow any vehicle into the BuyParking.co.uk Car Park except as part of the services offered by persons authorised by us and no work on nor cleaning of vehicles by you or your agent other than with our prior specific permission is permitted in the BuyParking.co.uk Car Park. In the event of vehicle breakdown you must contact the attendant to ensure that your vehicle removal or repair is organised without causing disruption, damage or danger to any other person or property in BuyParking.co.uk Car Park.

b. No activity in connection with the selling, hiring or other disposal of vehicles or goods or services shall be carried out in BuyParking.co.uk Car Park without our prior specific written permission.

14. YOUR USE OF THE BUYPARKING.CO.UK WEBSITE AND APP

You agree that you will not use the BuyParking.co.uk Website and App in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity or that is fraudulent, or has any unlawful or fraudulent purpose or effect. Furthermore, you agree not to do anything that may cause damage to the Website, App or our servers, systems or equipment or those of third parties, nor access any users’ data or penetrate or circumvent any Website and App security measures or attempt to do any such acts.
You agree not to infringe our intellectual property rights or those of any third party in relation to your use of the BuyParking.co.uk App, Website or any service (to the extent that such use is not licensed by these terms).
You agree not to give any indication that you have any commercial relationship with us, or that you are our agent or that we have endorsed any of your activities.
You are able to stop using the BuyParking.co.uk Website and App at any time. You confirm that you are able to do this at your sole discretion. We reserve the right to suspend, restrict or terminate your access to the BuyParking.co.uk Website and App or any part of it at any time at our sole discretion.

15. SANCTIONS

BuyParking.co.uk may at any time move, modify or remove any content or take further legal action as a result of breaches or suspected breaches of our terms of use or our privacy policy, any applicable laws or regulations, or where our rights or third party rights are threatened or infringed.

16. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all copyright and other intellectual property rights in our BuyParking.co.uk Website and App, and in the material published on it. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.
You are allowed to access and make personal use of the App. Your access and use of the App is not exclusive and not sub-licensable or transferable to any other party. We can also revoke your access and use of the App at any time. You acknowledge and agree:
not to rent, lease, sub-licence, loan, translate or modify the App or the Website;
not to alter or permit alteration of any part of the App or Website (including, without limitation, any paper copies);
not to make any part of the App available in object or source code to any person without prior written consent from us;
not to disassemble, decompile, reverse-engineer or create derivative works based on any part of the App or the Website (where applicable) or attempt to do any such thing except to the extent permitted by law, and provided that the information obtained by you during such activities:
is used only for achieving inter-operability of the App or Website with another software programme;
is not unnecessarily disclosed without our prior written consent to any third party; and
is not used to create any software that is substantially similar to the App or Website;
to comply with all laws that apply to the App or Website.
The names, images and logos identifying us, companies in our group, our partners or third parties and our/their products and services are proprietary marks and may not be reproduced or otherwise used without express permission.
The contents of the BuyParking.co.uk Website and App including (without limitation) web pages, computer codes of elements comprising the Website and App, and any software provided to you by us may not be copied, reproduced, communicated and/or made available to the public, republished, downloaded, posted, recorded, broadcast or transmitted or used in any other way except for your own personal, private and non-commercial use, unless otherwise expressly permitted by us and except where such copying is incidental to normal use of the App and Website, or where it is necessary for the purpose of back-up or operational security.
The restrictions in this section do not include your ability to use any of our “sharing” functions (for example, liking and sharing our BuyParking.co.uk Website or on social media Sites such as Facebook) in accordance with that third party’s own terms and conditions

17. PRICES

All prices are for pre-booking and include VAT at the current rate of 20% unless otherwise indicated.
All bookings are subject to a non-refundable booking fee.
High-sided or unusually wide vehicles: Not all car parks can accommodate them or there may be an extra charge. Please check MORE INFO on the product or contact our office for details before making a booking.

18. CANCELLATION POLICY

ALL CANCELLATIONS MUST BE MADE DIRECTLY THROUGH BUYPARKING.CO.UK IN ORDER TO BE VALID.
Please send an e-mail to info@buyparking.co.uk (Office hours only – Monday – Saturday 09.00 to 18.00) quoting your booking reference number. Please note that cancellation requests can only be performed within office hours and are subject to our notice periods.

Refund Notice Periods:

a) Customers who wish to cancel their booking and give less than 48 hours’ notice will receive no refund.
b) Customers who cancel the booking with BuyParking.co.uk and wish to re-instate the booking will not get any refund if cancelled thereafter.
c) Amendments of arrival date to any new future arrival date, where an amendment is requested on drop off /arrival day or within 24 hours prior to arrival date of the original booking. Such modified bookings cannot be amended and are non-refundable, if cancelled thereafter.
d) Should a client wish to cancel they must do so at least 24 hours prior to their departure date in order to be eligible for refund (All Bookings Fees and Cancellation Service Charges are non-refundable). No refund will be issued if the cancellation notice (Email / Call) is received in less than 24 hours from the drop off date.

19. USER CONTENT; SUBMISSIONS ON THE WEBSITE/APP

Any and all content contributed by the User in connection to our Services, including all photographs, articles, images, graphics, videos, sounds, music, audio recordings, text, files, profiles, communications, comments, feedback, reviews, suggestions, ideas, concepts, questions, data or other content (the “User Content”) is the responsibility of the User, not BUYPARKING.CO.UK, and is deemed non-confidential and nonproprietary.

By submitting or posting any User Content, you grant to BUYPARKING.CO.UK and its affiliates a perpetual, irrevocable, royalty-free, worldwide, sub licensable and transferable license to copy, publish, translate, modify, reformat, create derivative works from, distribute, reproduce, sell, display, transmit, publish, broadcast, host, archive, store, cache, use or otherwise exploit all or any portion of the User Content, as well as your name, persona and likeness included in any User Content and your social media account handle, username, real name, profile picture and/or any other information associated with the User Content, in any commercial or non-commercial manner whatsoever, in whole or in part, in any and all distribution channels, forms, media or technology, whether now known or hereafter developed, including but not limited to in stores, printed marketing materials, emails, web pages, social media accounts and for any other marketing, advertising, public relations, sales or promotional purposes with or without attribution and without further notice to you. Neither you nor any other person or entity, will have the right to

(i) receive any royalty or consideration of any kind for the use of the User Content pursuant to these Terms or

(ii) inspect or approve the editorial copy or other material that may be used in connection with the User Content. BUYPARKING.CO.UK shall have no obligation to monitor User Content, use or display User Content, compensate you for submitting User Content or respond to any User Content. BUYPARKING.CO.UK retains the right, in its sole discretion and without prior notice, to remove, revise or refuse to post any User Content for any reason or no reason. Subject to the licenses granted in these Terms, you retain ownership of any copyright and other rights you may have in the User Content.

By submitting or posting User Content on the Services, on your social media accounts or through any tools we provide for posting or sharing your User Content with us, you represent and warrant that

(i) you own or control any and all rights in and to the User Content, and the right to grant all of the rights and licenses in these Terms, and if you are not the holder of such rights, the holder of such rights has completely and effectively waived all such rights and irrevocably granted you the right to grant the licenses stated above without the need for payment to you or any other person or entity;

(ii) you have obtained permission from any individuals that appear in the User Content to use, and grant others the right to use, their name, image, voice and/or likeness without the need for payment to you or any other person or entity;

(iii) you are 18 years of age or older; and (iv) the User Content does not

(a) contain false or misleading information, (b) infringe on the intellectual property, privacy, publicity, statutory, contractual or other rights of any third party,

(d) contain any addresses, email addresses, phone numbers or any contact information or

(e) contain computer viruses, worms or other harmful files. Upon request by BUYPARKING.CO.UK, you will furnish BUYPARKING.CO.UK any documentation, substantiation, or releases necessary to verify your compliance with these Terms. You are solely responsible for the User Content and you hereby agree to indemnify and hold BUYPARKING.CO.UK and its employees, agents, affiliates, assigns, and licensees harmless from any and all damages, claims, expenses, costs, or fees arising from or in connection with a breach of any of the foregoing representations or your violation of any law or rights of a third party.

BUYPARKING.CO.UK HAS THE ABSOLUTE RIGHT TO REMOVE AND/OR DELETE WITHOUT NOTICE ANY USER CONTENT WITHIN ITS CONTROL THAT IT DEEMS OBJECTIONABLE. YOU CONSENT TO SUCH REMOVAL AND/OR DELETION AND WAIVE ANY CLAIM AGAINST BUYPARKING.CO.UK FOR SUCH REMOVAL AND/OR DELETION. BUYPARKING.CO.UK IS NOT RESPONSIBLE OR LIABLE FOR FAILURE TO STORE POSTED CONTENT OR OTHER MATERIALS YOU TRANSMIT THROUGH THE SERVICES. YOU SHOULD TAKE MEASURES TO PRESERVE COPIES OF ANY DATA, MATERIAL, CONTENT, OR INFORMATION YOU POST ON THE SERVICE OR ANY OTHER SITES OR SITES.

20. LINKS TO THIRD PARTY WEBSITES

The Sites may contain links to websites and other resources operated by third parties other than BUYPARKING.CO.UK. Such links are provided solely as a convenience to you. BUYPARKING.CO.UK does not control such websites, and is not responsible for the content, products, services or information offered by any third parties. Unless otherwise specified, the inclusion of links to such websites on the Sites does not imply any endorsement of any website or the content, products or services offered, advertised, endorsed or promoted by any third party, or of any BUYPARKING.CO.UK OR STX GROUP LIMITED or person. If you decide to access any third party websites or acquire any third party products or services, you do so entirely at your own risk, and you may be subject to the terms and conditions and the privacy policies imposed by such third parties.

21. DISCLAIMER OF WARRANTIES

You expressly acknowledge and agree that use of the BuyParking.co.uk Site is entirely at your own risk and that the Site is provided on an “as is” or “as available” basis, without any warranties of any kind. All express and implied warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights are expressly disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, BuyParking.co.uk, our officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the Site and your use thereof. We make no warranties or representations about the accuracy or completeness of any content on the Site and assumes no liability or responsibility for any

(i) errors, mistakes, or inaccuracies of any content made available through the Service,

(ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Services,

(iii) any unauthorized access to or use of our servers and/or any and all personal information and/or financial information stored therein,

(iv) any interruption or cessation of transmission to or from the Service,

(v) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the services by any third party, and/or
